DANIEL WELLINGTON INTERNATIONAL WARRANTY

The following Daniel Wellington limited warranty (“DW Warranty”) applies to original Daniel Wellington watches purchased in the original labelled packaging and sold or presented for warranty service in any country (the “DW Watch”).

1. WHAT THE DW WARRANTY COVERS AND DURING WHAT PERIOD

Under this DW Warranty, Daniel Wellington guarantees its DW Watch against defects in manufacturing and materials for a period of twenty-four (24) months from the date of original retail purchase (the “Warranty Period”). The DW Warranty is only applicable to watches purchased from the official Daniel Wellington webpage, from a Daniel Wellington store or an authorized reseller. Daniel Wellington will provide for repair or replacement of your DW Watch or part free of charge according to the DW Warranty terms. Please note that the rights conferred by the DW Warranty are in addition to the rights and remedies provided by consumer laws and regulations in your applicable jurisdiction. As such, the DW Warranty and its benefits are in addition to, and not instead of, rights provided by the applicable consumer law.

FOR AUSTRALIAN CONSUMER: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. LIMITATIONS TO THE DW WARRANTY (WHAT IT DOES NOT COVER)

The DW Warranty does not cover: (a) non-DW Watches, (b) batteries, straps, link bracelets or glass, (c) routine maintenance and cleaning, (d) damage of any kind if there is evidence that the damage was caused by an accident, improper use or mishandling of any part of the watch, handling that is inconsistent with the instructions or guidelines included with your DW Watch, lack of care or improper maintenance, tampering, abuse, wear and tear, or any other factor than a defect in the DW Watch’s manufacturing or material(s), (e) water penetration caused by use in conflict with the DW Watch’s ATM (Atmospheres) mark, (f) damage resulting from repair, service, or alteration by anyone other than an authorized Daniel Wellington retailer or service provider. Further, the DW Warranty shall become void if the serial number engraved on the watch’s case is missing or has been erased, altered, falsified, replaced, defaced, or made illegible.

3. WHAT WE WILL DO IN THE EVENT OF A WARRANTY CLAIM UNDER THE DW WARRANTY

If during the Warranty Period you submit a claim falls under this DW Warranty, Daniel Wellington will, at its discretion: (a) repair the DW Watch using new and/or previously used parts that are equivalent to new in performance and reliability; or (b) replace the DW Watch with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability. For warranty claim submitted in a country other than the country of purchase for the DW Watch, Daniel Wellington may repair or replace the DW Watch and/or parts with comparable DW Watch’s and/ or parts that comply with local standards. You will not be charged for the repair or replacement under this DW Warranty if your warranty claim within the scope of this DW Warranty. Furthermore, Daniel Wellington will be responsible for the costs of return shipping and handling for DW Warranty. If the DW Warranty is not applicable, void or rejected, Daniel Wellington will notify you accordingly and you may decide whether to proceed with the repair or replacement, or if you wish to have your watch returned. If you decide to proceed, you will be charged for part or all of any repair or replacement, including costs of return shipping and handling.

4. HOW TO OBTAIN OUR REPAIR SERVICE

To obtain repair or replacement of your DW Watch under this DW Warranty, please contact your local Daniel Wellington customer support by using the following address: us.danielwellington.com/pages/contact-us, one of the authorized Daniel Wellington stores or Daniel Wellington retailers. They will be able to provide information regarding our warranty service under this DW Warranty. Furthermore, in order to obtain repair or replacement under this DW Warranty, the returned DW Watch must be accompanied by a proof of purchase (i.e. receipt or the original Daniel Wellington warranty card/certificate that was included with the DW Watch in the original packaging at the time of purchase duly completed, dated, stamped and signed by an authorized Daniel Wellington store or retailer). If and when sending your DW Watch for repair or replacement, you must ensure it is packaged carefully to avoid any damage during shipping.

5. LIMITATION OF LIABILITY

Except as provided in this DW Warranty and to the maximum extent permitted by law, Daniel Wellington is not responsible for any direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of business; loss of opportunity; loss of goodwill. Subject to the applicable laws and regulations, the maximum liability of Daniel wellington for breaching any written or implied warranty with respect to the DW watch shall not exceed the retail purchase value of the DW watch.
